Astfel, angajatorul are obliga\u0163ia de a asigura participarea la programe de preg\u0103tire profesional\u0103:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; &#8211; cel putin o dat\u0103 la 2 ani, daca au cel pu\u0163in 21 de salaria\u0163i;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; &#8211; cel putin o dat\u0103 la 3 ani, daca au sub 21 de salaria\u0163i.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&nbsp;&nbsp;&nbsp; &nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;Angajatorii persoane juridice care au nu mai mult de 20 de salariati elaboreaz\u0103 anual \u015fi aplic\u0103 planuri de formare profesional\u0103, cu consultarea sindicatului sau dupa caz, a reprezentan\u0163iilor salaria\u0163iilor.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Codul muncii reglementeaz\u0103 generic formele \u00een care se poate realiza formarea profesional\u0103 a salariatilor, prin cursuri organizate fie de furnizorii de formare profesional\u0103, fie de angajatori \u00een cadrul unit\u0103\u0163ilor proprii, l\u0103s\u00e2nd celor dou\u0103 p\u0103r\u0163i posibilitatea s\u0103 convin\u0103 si alte forme de pregatire.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Formarea profesional\u0103 are ca principale obiective:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; &#8211; adaptarea salariatului la cerin\u0163ele postului sau ale locului de munc\u0103;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; &#8211; ob\u0163inerea unei calific\u0103ri profesionale;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; &#8211; actualizarea \u015fi dob\u00e2ndirea unor cuno\u015ftin\u0163e avansate, a unor metode \u015fi procedee moderne;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; &#8211; perfec\u0163ionarea preg\u0103tirii \u015fi dezvoltarea carierei profesionale;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; &#8211; reconversia profesional\u0103 prin schimbarea calific\u0103rii, determinat\u0103 de restructur\u0103ri economice, de modific\u0103ri ale capacit\u0103\u0163ii de munc\u0103.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Astfel avem de a face cu o formare profesional\u0103 ini\u0163ial\u0103 care asigur\u0103 pregatirea necesar\u0103 pentru dob\u00e2ndirea competen\u0163elor profesionale minime necesare pentru ob\u0163inerea unui loc de munc\u0103, \u015fi cu o formare profesional\u0103 continu\u0103 care este ulterioar\u0103 form\u0103rii ini\u0163iale \u015fi asigur\u0103 dezvoltarea competen\u0163elor profesionale deja dob\u00e2ndite sau dob\u00e2ndirea de noi competen\u0163e.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Formarea se poate realiza prin:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; &#8211; participarea la cursuri organizate de c\u0103tre angajator sau de c\u0103tre furnizorii de servicii de formare profesional\u0103;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; &#8211; stagii de adaptare profesional\u0103 fie la cerin\u0163ele postului, fie ale locului de munc\u0103;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; &#8211; stagii de practic\u0103 \u015fi specializare;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; &#8211; ucenicie organizat\u0103 la locul de munc\u0103;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; &#8211; alte forme de preg\u0103tire care pot fi convenite \u00eentre angajator \u015fi salariat.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Participarea la cursuri sau stagii de formare profesional\u0103 poate fi ini\u0163iat\u0103 de anajator sau de salariat.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; C\u00e2nd initiativa apartine angajatorului, toate cheltuielile ocazionate de participare sunt suportate de acesta, salariatul beneficiind de drepturi salariale, \u00een cazul scoaterii par\u0163iale din activitate, sau de o indemniza\u0163ie c\u00e2nd scoaterea este integral\u0103. De\u015fi \u00een aceast\u0103 ultim\u0103 situa\u0163ie contractul individual de munc\u0103 se suspend\u0103, salariatul beneficiaz\u0103 de vechime la acel loc de munc\u0103, perioada ce este considerat\u0103 stagiu de cotizare \u00een sistemul asigur\u0103rilor sociale de stat.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; \u00cen cazul \u00een care participarea la curs sau stagiu de formare profesional\u0103 este mai mare de 60 de zile \u015fi presupune scoaterea din activitate pe o perioada mai mare de 25% din durata zilnic\u0103 a timpului normal de lucru, sau scoaterea integral\u0103 din activitate, cele doua p\u0103r\u0163i, angajatorul \u015fi salariatul \u00eencheie un act adi\u0163ional la contractul individual de munc\u0103. Acest act aditional prevede imposibilitatea salariatului de a avea initiativa \u00eencet\u0103rii contractului individual de munc\u0103 pe o perioad\u0103 de cel pu\u0163in 3 ani de la data absolvirii cursurilor sau stagiului de formare profesional\u0103. Nerespectarea de c\u0103tre salariat a acestei obliga\u0163ii, determin\u0103 obligarea acestuia la suportarea tuturor cheltuielilor, propor\u0163ional cu perioada nelucrat\u0103 din cea stabilit\u0103 prin actul adi\u0163ional. Obiga\u0163ia cade \u00een sarcina salaria\u0163iilor \u015fi \u00een cazul \u00een care salariatul a fost concediat pentru motive ce \u0163in de persoana lor.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Atunci c\u00e2nd ini\u0163iativa particip\u0103rii la o form\u0103 de pregatire profesional\u0103 cu scoaterea din activitate apar\u0163ine salariatului, r\u0103mane la latitudinea angajatorului s\u0103 decid\u0103 cu privire la condi\u0163iile de participare \u015fi modalitatea de suportare a costurilor.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; \u00centruc\u00e2t angajatorul are obliga\u0163ia de a asigura participarea la programe de preg\u0103tire profesional\u0103, codul muncii prevede \u015fi situa\u0163ia \u00een care nu este \u00eendeplinit\u0103 aceast\u0103 obliga\u0163ie, situa\u0163ie \u00een care salariatul are dreptul la un concediu pentru formare profesional\u0103, pl\u0103tit de angajator, de p\u00e2n\u0103 la 10 zile lucr\u0103toare sau de p\u00e2n\u0103 la 80 de ore.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Formarea profesional\u0103 organizat\u0103 de angajator se realizeaza prin intermediul unor contracte speciale:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; &#8211; contractul de calificare profesional\u0103, contract prin care salariatul se oblig\u0103 s\u0103 urmeze cursurile de formare organizate de angajator pentru dob\u00e2ndirea unei calific\u0103ri profesionale. Pot \u00eencheia un astfel de contract salaria\u0163ii cu v\u00e2rsta minim\u0103 de 16 ani, care nu au o calificare sau au o calificare care nu le permite men\u0163inerea locului de munc\u0103 la acel angajator, iar contractul se poate \u00eencheia pe o perioad\u0103 cuprins\u0103 \u00eentre 6 luni \u015fi 2 ani.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; &#8211; contractul de adaptare profesional\u0103 care se \u00eencheie \u00een scopul adapt\u0103rii salaria\u0163ilor la o nou\u0103 func\u0163ie, la un nou loc de munc\u0103 \u015fi pe o perioad\u0103 determinat\u0103, dar nu mai mare de un an de zile.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Putem observa atat obligativitatea angajatorului de a organiza programe de preg\u0103tire profesional\u0103 periodice, c\u00e2t \u015fi obliga\u0163ia salariatului de a munci \u00een subordinea angajatorului o perioada dup\u0103 absolvirea unor astfel de programe.
